Biography
Frank Pan has 20 years of experience working in a broad range of trade actions, including advising clients on trade law compliance, export control, trade remedy, and other PRC regulatory and customs issues related to supply chain planning and managing disputes with PRC regulators. Frank was previously a partner with a PRC law firm, which is a member firm of a Big Four Firm in Shanghai, and prior to that, an of-counsel of Baker McKenzie where he was one of the leaders of the Firm’s China Trade and Supply Chain practice for over 6 years. He had also worked at a leading Chinese trade boutique law firm for over 7 years, where he acted for more than 50 Chinese and multinational corporations in responding to trade remedy actions instigated by US, EU, PRC and other jurisdictions.
Frank's practice focuses are international trade compliance, export control and sanctions, supply chain planning, trade remedies, and customs audits and investigations.
Representative Legal Matters
- Provided advice as a "go-to" advisor of a US leading advanced testing instrument and measurement manufacturer, covering a broad range of customs regulatory and trade compliance matters, and assisted the client with numerous sanctions, export control and customs compliance projects.
- Advised China's leading electric vehicle company with operations around the globe on responsible sourcing and establishment of a comprehensive supply chain compliance program.
- Assisted a US leading integrated circuit developer in conducting China export control risk assessment and establishing a China-specific export compliance program to address the identified risk areas.
- Advised one of the world's leading semiconductor suppliers on the risks of Chinese retaliatory sanctions and blocking rules in view of the potential escalation of US/EU export controls against China, and assisting with the implementation of the identified mitigation strategies.
- Acted for a US automobile manufacturer in administrative and judicial reviews of a valuation decision rendered by Chinese Customs involving significant customs duty liability and industry-wide impact.*
- Advised a leading global jet manufacturer on the China customs, trade, regulatory and free trade zone policies and preparation of a joint venture agreement in connection with its joint venture project in China.*
- Acted for a leading US agricultural supplier in the antidumping investigation involving sorghum from the US before China Ministry of Commerce.
